The opposition was based on a number of FOCUS marks and a WEB FOCUS mark, in classes 9, 16 & 42. These were subject to the Proof of Use regulations, and the Hearing Officer went on to examine the matter under Section 5(2)(b), using the surviving marks/specifications.
In the result, the Hearing Officer did not find a likelihood of confusion.
