Summary
An application to revoke the patent, which relates to embossed latex gloves, was based on added matter, novelty and obviousness. Neither side presented any expert evidence. The claimant attempted to shift the focus of its case late in the proceeding beyond that which was originally pleaded. This was objected to by the defendant. The hearing officer subsequently refused to consider a new added matter attack. The patent was found to be valid.
