The European Communities (Designation) Order 1972

Whereas a draft of this Order has been laid before Parliament and approved by resolution of each House:

Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 2(2) of the European Communities Act 1972, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

Citation, interpretation and commencement

1.-(1) This Order may be cited as the European Communities (Designation) Order 1972.

(2) The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

(3) This Order shall come into operation on the day after it is made.

Designations of Ministers or departments

2.-(1) For the purposes of section 2(2) of the European Communities Act 1972 the Ministers or government departments specified in column 1 of the Schedule to this Order are hereby designated in relation to the matters respectively specified in column 2 of that Schedule.

(2) Where a Minister or government department is designated in relation to any item in column 2 of the said Schedule, then, for the purposes of the said section 2(2), that Minister or government department is also hereby designated in relation to anything supplemental or incidental to the matters specified in that item.

(3) Without prejudice to the generality of paragraph (2) above, the designation by this Order of any Minister or government department, in relation to anything supplemental to any item in column 2 of the said Schedule, shall be taken to include designation in relation to the charging of fees in connection with any of the matters specified in that item.

(4) Where more than one Minister or government department is designated by this Order in relation to any matter, the designation has effect as respects the making of regulations by any of them, or by more than one of them acting jointly.

(5) Regulations made by a Minister or department of the Government of Northern Ireland in pursuance of this Order shall form part of the law of Northern Ireland, and not of any other part of the United Kingdom.

Ministers or departments Matters in relation to which the Ministers or departments are designated
The Secretary of State

Terms and conditions of carriage of goods by any mode of transport, and in particular-

(a) discrimination or undue preference in the carriage of goods, and

(b) maximum and minimum rates for the carriage of goods by road on routes between Member States.

The Secretary of StateInternational carriage of passengers and goods by road, and in particular any scheme (including a quota scheme) for making it possible for carriers in Member States to conduct road transport operations on routes between Member States.
The Secretary of StateThe collection of information about the carriage of goods by road.
The Secretary of StateCompulsory insurance in respect of, and other means of providing for, civil liability in relation to motor vehicles and trailers.
The Secretary of StateRegulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme.
The Secretary of State

Measures for safety and consumer protection as respects the following products, and any provisions concerning the composition, labelling, marketing, classification or description of those products, that is to say-

  • aerosols

  • cosmetic products

  • crystal glass

  • detergents

  • electrical equipment

  • household products

  • textiles and products incorporating textiles, and

  • wood in the rough or timber.

The Secretary of State

The collection of information concerning-

(a) imports of hydro-carbons, and

(b) investment projects in the petroleum sector.

The Secretary of StateMeasures relating to redundancy among steel workers.
The Secretary of StateExchange of young workers within the Economic Community.
The Minister of Agriculture, Fisheries and Food and the Secretary of State.The common agricultural policy of the Economic Community.
The Secretary of State and the Minister of Agriculture, Fisheries and Food.Medicinal products.
Any Minister or department of the Government of Northern Ireland.All the preceding items in this column.

EXPLANATORY NOTE

This Order designates Ministers who may exercise powers to make regulations conferred by section 2(2) of the European Communities Act 1972 and specifies the matters in relation to which those powers may be exercised.
