The Queen's Most Excellent Majesty in Council
Her Majesty, in exercise of the powers conferred on Her by section 2(2) of the European Communities Act 1972, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-
1. This Order may be cited as the European Communities (Designation) (No. 3) Order 1985 and shall come into operation on 30th August 1985.
2.-(1) For the purposes of section 2(2) of the European Communities Act 1972 the Secretary of State and any Northern Ireland department are hereby designated in relation to the regulation and control of the transit, import and export of waste (including recyclable materials) which is dangerous or which requires the taking of special precautions and in relation to anything supplemental or incidental to those matters.
(2) Paragraph (1) above has effect as respects the making of regulations by the Secretary of State or a Northern Ireland department, or by more than one of them acting jointly.
(3) Regulations made by a Northern Ireland department in pursuance of this Order shall form part of the law of Northern Ireland and not of any other part of the United Kingdom.

This Order designates the Minister who and departments which may exercise powers to make regulations conferred by section 2(2) of the European Communities Act 1972 and specifies the matters in relation to which those powers may be exercised.
