The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) (No. 2) Regulations 1986

The Secretary of State for Transport, in exercise of the powers conferred by section 40(1) and (3) of the Road Traffic Act 1972, and now vested in him(1), section 6 of the Public Passenger Vehicles Act 1981, and of all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of the said Act of 1972 and section 61(2) of the said Act of 1981(2), hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Public Service Vehicles (conditions of Fitness, Equipment, Use and Certification) (Amendment) (No. 2) Regulations 1986 and shall come into operation on 26th November 1986.

Amendment of Regulations

2. The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981(3) are hereby further amended in accordance with the following provisions of these Regulations.

3. In regulation 3(1), after the definition of a "half-decked vehicle" there shall be inserted the following-

""minibus" means a motor vehicle which is constructed or adapted to carry more than 8 but not more than 16 seated passengers in addition to the driver;".

4. In regulation 4, there shall be inserted after paragraph (2) the following-

"(2A) Notwithstanding regulation 5,regulations 6 to 33, 35 to 44 and 45A shall not apply to minibus which either complies with, or is required to comply with, or is exempted from the requirements specified in regulations 41 to 43 of the Road Vehicles (Construction and Use) Regulations 1986(4) for a minibus first used within the meaning of those Regulations on or after 1st April 1988.".

EXPLANATORY NOTE

These Regulations further amend the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981 ("the principal Regulations") and take account of the Road Vehicles (Construction and Use) Regulations 1986 ("the Construction and Use Regulations"). Minibuses which are required to comply with, or are exempted from, regulations 41 to 43 of the Construction and Use Regulations (which relate to construction, fire extinguishing apparatus and first aid equipment), or which comply with those regulations although not required to do so, are exempted from specified provisions of the principal Regulations relating to conditions as to fitness (for the issue of a certificate of initial fitness), fire extinguishing apparatus, first aid equipment, and use requirements (regulation 4).
