The Reservoirs Act 1975 (Commencement No. 4) Order 1986

10th December 1986

The Secretary of State, in exercise of his powers under section 29 of the Reservoirs Act 1975 and section 6(3) of the Local Government (Interim Provisions) Act 1984 and of all other powers enabling him in that behalf, orders as follows:-

1. This order may be cited as the Reservoirs Act 1975 (Commencement No. 4) Order 1986.

2.-(1) The provisions of the Reservoirs Act 1975 specified in the Schedule to this order shall come into force on 1st April 1987 in Greater London and the metropolitan counties.

(2) Article 2(3)(ii) of the Reservoirs Act 1975 (Commencement No. 2) Order 1985 and article 2(2) of the Reservoirs Act 1975 (Commencement No. 3) Order 1986 shall be revoked on 1st April 1987.

EXPLANATORY NOTE

This order brings into force on 1st April 1987, in Greater London and the metropolitan counties, all the provisions of the Reservoirs Act 1975 not already in force in those areas. The majority of these provisions concern the safety of reservoirs. They require that suitably qualified engineers be employed in connection with their construction, inspection and supervision.

Earlier commencement orders (S.I. 1985/176 and S.I. 1986/466) modified the provisions that they brought into force so that they would apply to any large raised reservoir only partly in Greater London or one or more metropolitan county as if it were wholly within the non-metropolitan county or countries in which it was also partly situated. Article 2(2) of this order revokes the provisions that made those modifications.

When this order comes into force all the provisions of the Reservoirs Act 1975 will be in force without modification or limitation, throughout England, Wales and Scotland.
