The Minister of Agriculture, Fisheries and Food, the Secretary of State for Social Services and the Secretary of State for Wales acting jointly, in exercise of the powers conferred on them by sections 4, 7, and 118 of the Food Act 1984((1)) and of all other powers enabling them in that behalf, hereby make the following Regulations, after consultation in accordance with section 118(6) of the said Act with such organisations as appear to them to be representative of interests substantially affected by the Regulations:-

Title and commencement

1. These Regulations may be cited as the Colouring Matter in Food (Amendment) Regulations 1987, and shall come into force on 2nd January 1988.Amendment of the Colouring Matter in Food Regulations 1973((2))

2. The Colouring Matter in Food Regulations 1973 shall be further amended-

(a)by substituting for regulation 5(2) thereof the following paragraphs:-

"(2) Save as hereinafter provided, no food specially prepared for babies and young children, tea (whether in leaf or essence form), coffee, coffee product, condensed milk or dried milk, sold, consigned, delivered or imported into England and Wales for human consumption shall have in it or on it any added colouring matter.

(2A) Nothing in the preceding paragraph shall prohibit the presence in food specially prepared for babies and young children of any of the vitamin sources Riboflavin or Lactoflavin E101, Riboflavin-5-phosphate and beta-Carotene E160(a) which complies with the specific purity criteria specified in relation thereto in Part II of Schedule 1 to these Regulations and with the general purity criteria specified in Part III of that Schedule.";

(b)by deleting from the table in Part I of Schedule 1 thereto (which describes permitted colouring matters) and from Part II of that Schedule (which specifies the specific purity criteria relating to those colouring matters) the items relating to the colouring matter Yellow 2G;

(c)by deleting the final entry in each of columns 1, 2 and 3 of Schedule 3 thereto (which specifies colouring matters permitted only in certain foods) namely, the words "Citrus fruit", "Methyl Violet" and "For marking only" respectively.

Explanatory Note

(This note is not part of the Regulations)

These Regulations apply to England and Wales and come into force on 2nd January 1988. They further amend the Colouring Matter in Food Regulations 1973 by-

(a)prohibiting the presence in food specially prepared for babies and young children of added colouring matter other than the vitamin sources Riboflavin or Lactoflavin E101, Riboflavin-5-phosphate and beta-Carotene E160(a) which comply with prescribed purity criteria (regulation 2(a));

(b)removing Yellow 2G from the list of colouring matters permitted in or on food (regulation 2(b));

(c)revoking the permission for citrus fruit to be marked with Methyl Violet (regulation 2(c)).
