SOCIAL SECURITY

The Social Security (Notification of Deaths)Regulations 1987

The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 60, 83(1) and 84(1)(1) of the Social Security Act 1986(2), and of all other powers enabling him in that behalf, by this instrument, which is made before the expiry of the period of 12 months beginning with the commencement of those sections, makes the following regulations:-

Citation, commencement and interpretation

1.-(1) These regulations may be cited as the Social Security (Notification of Deaths) Regulations 1987 and shall come into force on 6th April 1987.

(2) In these regulations "data material" has the same meaning as in section 41 of the Data Protection Act 1984(3).

Notification of particulars of deaths

2.  The particulars of death which are required to be furnished to the Secretary of State under these regulations are required to be so furnished for the purposes of his functions under the benefit Acts and the functions of the Department of Health and Social Services for Northern Ireland under any corresponding Northern Ireland legislation.

Deaths in England or Wales

3.  In respect of deaths occurring in England or Wales, it shall be the duty of each registrar of births and deaths, in relation to deaths registered by him, to furnish the Secretary of State with such particulars of the death of a person as are specified in Schedule 1 to these regulations, or as many of such particulars as are available to him, as soon as it is reasonably practicable to do so.

Deaths in Scotland

4.  In respect of deaths occurring in Scotland, it shall be the duty of the Registrar General of Births, Deaths and Marriages for Scotland in relation to deaths notified to him, to furnish the Secretary of State with such particulars of the death of a person as are specified in Schedule 2 to these regulations, or as many of such particulars as are available to him, as soon as it is reasonably practicable to do so.

Manner in which particulars are to be furnished

5.  The prescribed manner in which particulars are required to be furnished to the Secretary of State under these regulations, is either in writing or on data material.

Regulation 3

SCHEDULE 1PARTICULARS OF A DEATH OCCURRING IN ENGLAND OR WALES REQUIRED TO BE NOTIFIED TO THE SECRETARY OF STATE

1.  The surname and forenames of the deceased.

2.  The date and place of death.

3.  The sex of the deceased.

4.  The maiden surname of a deceased married, widowed or divorced woman.

5.  The date and place of birth of the deceased.

6.  The occupation of the deceased.

7.  The usual address of the deceased at the date of death.

Regulation 4

SCHEDULE 2PARTICULARS OF A DEATH OCCURRING IN SCOTLAND REQUIRED TO BE NOTIFIED TO THE SECRETARY OF STATE

1.  The surname and forenames of the deceased.

2.  The date of death.

3.  The sex of the deceased.

4.  The maiden surname of a deceased married, widowed or divorced woman.

5.  The date of birth of the deceased.

6.  The place of usual residence of the deceased.

7.  The district where the death was registered.

Explanatory Note

(This note is not part of these Regulations)

These Regulations require registrars of births and deaths, in England and Wales, and the Registrar General of Births, Deaths and Marriages for Scotland to provide specified particulars of death to the Secretary of State for Social Services.

These Regulations are made under sections 60, 83(1) and 84(1) of the Social Security Act 1986 and are also made before the expiry of a period 12 months of the commencement of those sections, that is on 6th April 1987 and 25th July 1986. Accordingly they are exempt by section 61(5) of that Act, from the requirement of section 10(1) of the Social Security Act 1980 (c. 30) to refer proposals to the Social Security Advisory Committee and are made without reference to that Committee.
