The Supplementary Benefit Uprating Regulations 1987

The Secretary of State for Social Services, in exercise of the powers conferred on him by sections 2(2) and 34(1) (1) of, and paragraph 2(1) and (4) of Schedule 1 to the Supplementary Benefits Act 1976 (2) and of all other powers enabling him in that behalf, with the consent of the Treasury (3) and, so far as is required (4), after agreement by the Social Security Advisory Committee that the proposals to make these regulations should not be referred to it (5), hereby makes the following regulations of which a draft has, in accordance with section 33(3) of that Act, been laid before Parliament and approved by a resolution of each House of Parliament:-

Citation, commencement and interpretation

1.-(1) These regulations may be cited as the Supplementary Benefit Uprating Regulations 1987 and shall come into force on 6th April 1987.

(2) In these regulations "Requirements Regulations" means the Supplementary Benefit (Requirements) Regulations 1983 (6).

Amendment of amounts specified in the Requirements Regulations

2.-(1) The Requirements Regulations shall be amended in accordance with the following provisions of this regulation.

(2) In regulation 5 (normal requirements of relevant persons)-

(a)in paragraph (1)(c) for "£1.30" there shall be substituted "£1.40";

(b)in paragraph (2)(d) for "£0.75" there shall be substituted "£0.70"; and

(c)in paragraph (3)(b) for "£0.80" there shall be substituted "£0.85".

(3) In regulation 9(12) (personal expenses of boarders) for "£9.05" there shall be substituted "£9.25" and-

(a)in sub-paragraph (a), in head (i) for "£21.90" and in head (ii) for "£19.60" there shall be substituted "£22.30" and "£20.00" respectively;

(b)in sub-paragraph (b), in head (i) for "£10.95" and in head (ii) for "£9.80" there shall be substituted "£11.15" and "£10.00" respectively; and

(c)in sub-paragraph (c), in head (i) for "£9.80", in head (ii) for "£5.90", in head (iii) for "£5.05" and in head (iv) for "£3.30" there shall be substituted "£10.00", "£6.00", "£5.15" and "£3.35" respectively.

(4) In regulation 16(1) (maintenance and insurance), for "£1.85" there shall be substituted "£1.95".

(5) In regulation 22(3) (reduction in amounts where the home is occupied by a non-dependant)-

(a)in sub-paragraph (a), in head (i) for "£2.80", in head (ii) for "£7.80" and in head (iii) for "£2.80", there shall be substituted "£2.90", "£8.05" and "£2.90" respectively; and

(b)in sub-paragraphs (b), (c) and (d) for "£2.80" there shall be substituted "£2.90".

(6) In regulation 23(1) (non-householder's contribution) for "£3.90" there shall be substituted "£4.05".

(7) In Schedule 1 (normal requirements), for the amount specified in column (2) of that Schedule in relation to each provision specified in column (1) thereof, such amount being set out in column 2 of the First Schedule to these regulations, there shall be substituted the amount set out in relation to that provision in column 3 of that First Schedule.

(8) In Schedule 4 in paragraphs 14 and 17 (diet and hospital fares) for the amount specified in column (2) of that Schedule in relation to each provision specified in column (1) thereof, such amount being out in column 2 of the Second Schedule to these regulations, there shall be substituted the amount set out in relation to that provision in column 3 of that Second Schedule.

Explanatory Note

(This note is not part of the Regulations)

These Regulations alter certain amounts specified in the Supplementary Benefit (Requirements) Regulations 1983 for the purpose of determining entitlement to supplementary benefit under the Supplementary Benefit Act 1976. They vary amounts for a person's normal requirements (regulation 2(2) and (7)). They increase certain allowances for personal expenses for persons in board and lodging accommodation (regulation 2(3)); the weekly amount payable for maintenance and insurance of the home (regulation 2(4)); the reduction to be made in certain payments in respect of housing where the home is occupied by non-dependants (regulation 2(5)); the amount of the non-householder's contribution (regulation 2(6)); certain amounts of additional requirements relating to diet and the reduction made in certain circumstances to amounts paid in respect of fares for hospital visiting (regulation 2(8)).
