The Minister of Agriculture, Fisheries and Food and the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 7(1), 8(1), 14(1) and (2), 15(4), 17(1), 23 and 25 of the Animal Health Act 1981(1) and of all other powers enabling them in that behalf, order as follows:-
1. This Order may be cited as the Sheep Scab (Amendment) Order 1987 and shall come into force on 27th May 1987.
2.-(1) The Sheep Scab Order 1986(2) shall be amended in accordance with the provisions of this article.
(2) In paragraph (3)(a)(ii) of article 15 (declaration to be made in respect of the movement of any sheep out of an infected area) after the words "from which" there shall be inserted the words ", and to which,".
(3) For paragraph (4) of article 17 (issue by the local authority of licences for the holding of markets) there shall be substituted the following paragraph-
"(4) A licence to hold a market issued by the local authority under paragraph (3) above may permit the holding of a market for-
(a)dipped sheep, on the condition that no sheep other than dipped sheep are present in, or admitted to, the same market on the same day;
(b)slaughter sheep, on the condition that no sheep other than slaughter sheep are present in, or admitted to, the market on the same day; or
(c)both dipped and slaughter sheep, on the condition that adequate provision is made (to the local authority's satisfaction) to ensure that slaughter sheep and dipped sheep are kept separate from each other whilst they are in the market,
and, in each case, on the condition that adequate facilities for the cleansing and disinfection of vehicles in which sheep have been carried to the market are available at, or in the immediate vicinity of, the market".
(4) In paragraph (2)(a) and (b) of article 24 (movement of any sheep on to or out of approved holding premises under licence) for the words "in Form H1" there shall be substituted the words "in Form H2" and consequently in Form H1 the reference to article 24 shall be omitted.
(5) In paragraphs (1)(a) and (2) of article 27 (record keeping by sheep dealers) after the words "in Form P" there shall be inserted the words "or in a form substantially to the like effect".
(6) At the end of paragraph (2) of article 30 (sampling of fleeces) there shall be added the words "and shall comply with all reasonable requirements of the inspector with a view to facilitating the taking of such samples".
(7) In Schedule 1 (forms)-
(a)in Form H1, in the Table, after column (4) there shall be inserted the following column-
"5 Date of dipping, address of premises where dipped and name of dip used" |

(b)in Form J, in the first and second Tables-
(i)for the second column there shall be substituted the following column-
"Address of premises where dipped" |

(ii)for the fourth column there shall be substituted the following column-
"Name of dip used" |

(This note is not part of the Order)
This Order amends the Sheep Scab Order 1986. The changes of substance made by this Order are the inclusion of provisions in the 1986 Order which-
(1) permit a sheep dealer to keep records of sales of sheep for the purposes of article 27 of the 1986 Order in a form which is in effect substantially the same as Form P set out in Schedule 1 to the 1986 Order (article 2(5)); and
(2) require the occupier of any premises on which there are sheep and the owner or person in charge of the sheep to comply with all reasonable requirements of an inspector with a view to facilitating the taking of samples of the fleece of those sheep by the inspector under article 30(2) of the 1986 Order (article 2(6)).
