In exercise of the powers conferred by sections 122(3) and 126(2) of, and paragraph 4 of Schedule 7 to, the Education Reform Act 1988(1) the Secretary of State for Education and Science, having obtained the consent of the local education authority concerned as required by section 122(5) of that Act, and having consulted in accordance with the said paragraph such associations of local authorities as appeared to him to be concerned, hereby makes the following Order:
1. This Order may be cited as the Education (Higher Education Corporations) (No. 2) Order 1988 and shall come into force on 21st November 1988.
2. There shall be established, as from 21st November 1988, a body corporate to conduct, as from 1st April 1989, the institution known as the Winchester School of Art being an institution which appears to the Secretary of State to satisfy the criteria set out in section 122(3) of the Education Reform Act 1988.
3. 1st April 1989 is hereby appointed as the transfer date for the said corporation for the purposes of section 126 of that Act.
4. The County Council of Hampshire and the Council of the City of Winchester are each hereby specified as a local authority entitled to nominate a local authority nominee as an initial nominee member of the said corporation.

This Order makes provision for the establishment of a body corporate to conduct the Winchester School of Art. That body which, by virtue of paragraph 1(2) of Schedule 7 to the Education Reform Act 1988 will have the name of the Winchester School of Art, is established on 21st November 1988 to prepare itself for the conduct of that institution from 1st April 1989 which is appointed as the transfer date for the purposes of section 126 of that Act. It also specifies the County Council of Hampshire and the Council of the City of Winchester as local authorities each able to nominate a local authority nominee to become a member of that body corporate.
