The Cycle Racing on Highways (Amendment) Regulations 1988

The Secretary of State for Transport (in relation to England) and the Secretary of State for Wales (in relation to Wales) in exercise of the powers conferred on them by section 20(2) and (3) of the Road Traffic Act 1972(1), and now vested in them(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 199(2) of the said Act, hereby makes the following Regulations:-

1. These Regulations may be cited as the Cycle Racing on Highways (Amendment) Regulations 1988 and shall come into force on 15th March 1988.

2. The Cycle Racing on Highways Regulations 1960(3) shall be further amended in accordance with the following provision of these Regulations.

3. In regulation 5(1)(a)(i) for the words"of 70 Brompton Road, London, 84" there shall be substituted the number"100".

Explanatory Note

(This note is not part of the Regulations)

1. The Cycle Racing on Highways Regulations 1960, as amended, which apply to England and Wales, authorise certain races or trials of speed between bicycles or tricycles, not being motor vehicles, (described in those Regulations as bicycle races) to be held on public highways subject to certain conditions including conditions as to the number of competitors taking part.

2. These Regulations increase the number of competitors for two races selected in any one year by the British Cycling Federation from 84 to 100, and omit the address given in the Regulations for the Federation.

3. These Regulations do not apply to Scotland.

In relation to England, in the Secretary of State for Transport by virtue of S.I. 1976/1775, 1979/571 and 1981/238. In relation to Wales, in the Secretary of State for Wales. The Cycle Racing on Highways Regulations 1960 (S.I. 1960/250), were made by the Minister of Transport under s.13 of the Road Traffic Act 1956 (c. 67). That section was repealed by s.267(1) and Schedule 18 Part I of the Road Traffic Act 1960 (c. 16), but was re-enacted in s.12 of that Act. By virtue of article 3(1) and Schedule 2 Part I of S.I. 1965/319 the functions of the Minister for Transport under s.12 of the Act of 1960 in their application to Wales were transferred to the Secretary of State for Wales. S.12 of the Act of 1960 was repealed by s.205(1) and Schedule 9 Part I of the Road Traffic Act 1972 (c. 20), but was re-enacted in s.20 of the Act of 1972.
