CHANGES IN LOCAL GOVERNMENT AREAS

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
1.-(1) This Order may be cited as the Derbyshire (District Boundaries) Order 1988.
(2) This Order shall come into force on 22nd February 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976(2).
(3) For all other purposes this Order shall come into force on 1st April 1988.
2. In this Order-
"borough ward" means a ward of the borough of Chesterfield;
"boundary map" means one of the 5 maps prepared by the Department of the Environment, marked "Maps of the Derbyshire (District Boundaries) Order 1988", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;
"county electoral division" means an electoral division of the county of Derbyshire;
"district ward" means a ward of the district of North East Derbyshire.
3. The areas marked on the boundary map as shown in columns 1 and 2 of the Schedule to this Order shall cease to be part of the relevant local government areas named in column 3, and shall become part of the relevant local government areas named in column 4 and of the borough or district ward and the county electoral division named in column 5.
4. Any provisions of a local plan adopted by the council of a district which apply immediately before 1st April 1988 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the council of the district to which the area is transferred.

(This note is not part of the Order)
This Order-
(a)transfers areas between the borough of Chesterfield and the district of North East Derbyshire; and
(b)makes consequential changes to parishes and electoral areas in those districts.
The map forming part of this note (page 6) gives a general guide to the areas affected. Prints of the detailed boundary maps (described in article 2) may be inspected at all reasonable times at the offices of the Chesterfield Borough Council and the North East Derbyshire District Council and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P 3EB.
The areas transferred from Chesterfield to North East Derbyshire have together approximately an area of 141.2 hectares, a population of 538 and a rateable value of £45,542.
The areas transferred from North East Derbyshire to Chesterfield have together approx-imately an area of 166.5 hectares, a population of 1,873 and a rateable value of £251,452.
The Local Government Area Changes Regulations 1976 (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
