The Secretary of State for Transport, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme, in exercise of the powers conferred on him by the said section 2(2), and of all other enabling powers, hereby makes the following Regulations:
1. These Regulations may be cited as the Motorcycles (Sound Level Measurement Certificates) (Amendment) (No.2) Regulations 1989 and shall come into force on 1st October 1989.
2. The Motorcycles (Sound Level Measurement Certificates) Regulations 1980(3) are hereby amended in accordance with the following provisions of these Regulations.
3. In regulation 2(1) in the definition of "Council Directive" there shall be inserted after the words "18th December 1986" the words "and by Council Directive 89/235/EEC of 13th March 1989"(4).
4. In the form specified in Schedule 2 -�
(a)in the heading after "18th December 1986" there shall be inserted "and by Council Directive 89/235/EEC of 13th March 1989"; and
(b)at the end of paragraph 6 there shall be added "and by Council Directive 89/235/EEC"; and
(c)at the end of footnote (3) there shall be added "and by Council Directive 89/235/EEC".

The Motorcycles (Sound Level Measurement Certificates) Regulations 1980 ("the 1980 Regulations"), as amended, made provision as required under Council Directive 78/1015/EEC (on the approximation of the laws of the Member States on the permissible sound level and the exhaust systems of motorcycles) as amended by Council Directive 87/56/EEC for the issue of a sound level measurement certificate stating that a type of motorcycle complies with the harmonised requirements specified in Council Directive 78/1015/EEC amended as above.
These Regulations further amend the 1980 Regulations as a consequence of Council Directive 89/235/EEC which further amended Council Directive 78/1015/EEC.
Copies of the EEC Directive can be obtained from Her Majesty's Stationery Office. The details of the Directives are set out below.
