The Superannuation (Children's Pensions) (Earnings Limit) Order 1989

The Treasury, in exercise of the powers conferred by section 21(5) of the Judicial Pensions Act 1981(1) and now vested in them(2), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement

1. This Order may be cited as the Superannuation (Children's Pensions) (Earnings Limit) Order 1989 and shall come into force on 10th April 1989.

Increase in children's earnings limit

2. The sum mentioned in section 21(1)(c)(ii) of the Judicial Pensions Act 1981 (which excludes from the definition of "period of childhood and full-time education" a person over 16 who is undergoing training if the emoluments payable by his employer are more than the said sum) is hereby increased from £1227 to £1299.

Revocation of previous order

3. The Superannuation (Children's Pensions) (Earnings Limit) Order 1988(3) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

Subject to certain conditions section 21 of the Judicial Pensions Act 1981 permits the payment of a children's pension under that Act to continue after the child reaches the age of 16 if the child is undergoing training for a trade, profession or vocation. One of the conditions is that the emoluments received during training, excluding any emoluments receivable or payable by way of return of any premium paid in respect of the training, do not exceed £1227 a year. This Order revokes the Superannuation (Children's Pensions) (Earnings Limit) Order 1988 and increases the limit on such emoluments from £1227 to £1299 a year.
