The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (England) Order 1989 and shall come into force on 1st January 1990.

Exemption

2. The cleaning by the Common Council of the City of London of the premises in the City of London known as the Central Criminal Court shall not be treated as a defined activity within the meaning of section 2(2)(b) of the Local Government Act 1988 so long as the premises remain vested in the Common Council, in any capacity, and remain the courthouse of the Central Criminal Court.

Explanatory Note

(This note is not part of the Order)

This Order allows the Common Council of the City of London to carry out the cleaning of the Central Criminal Court (the "Old Bailey"), without having to put that activity out to tender under the provisions of the Local Government Act 1988, so long as it remains the courthouse for the Central Criminal Court.
