The Health and Medicines Act 1988 (Commencement No. 4) Order 1989

Made

12th May 1989

In exercise of powers conferred by section 26(1) of the Health and Medicines Act 1988(1) and of all other powers enabling me in that behalf, I hereby make the following Order:-

Citation and interpretation

1.-(1) This Order may be cited as the Health and Medicines Act 1988 (Commencement No. 4) Order 1989.

(2) In this Order, "the 1988 Act" means the Health and Medicines Act 1988.

Days appointed

2.-(1) 1st April 1990 is the day appointed for the coming into force of section 9 of the 1988 Act (reduction of practitioner's pension on re-employment after attaining the age of 65).

(2) 9th June 1989 is the day appointed for the coming into force of -�

(a)section 8 of the 1988 Act (retirement of practitioners) except for -�

(i)in subsection (1), paragraph (a),

(ii)in subsection (2), the words "(a) or";

(b)section 25(1) of the 1988 Act (consequential amendments) so far as it relates to paragraphs 4 and 11 of Schedule 2 to the 1988 Act, and to paragraphs 1 and 9 of that Schedule to the extent that they have effect for the purposes of those paragraphs;

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 1st April 1990 the provision of the Health and Medicines Act 1988 which relates to the reduction of a practitioner's pension on his re-employment after attaining the age of 65. The Order also brings into force on 9th June 1989 the provisions of that Act relating to the retirement of dental practitioners.

Note as to Earlier Commencement Orders

(This note is not part of the Order)

Section 11(7) of the Health and Medicines Act 1988 was brought into force on 1st January 1989 by S.I. 1988/2107 and section 25(2) of that Act was brought into force (partially) on 27th February 1989 by S.I. 1989/111. The remaining provisions of section 11, together with section 12 and section 13 and, to a limited extent, section 25(1) were brought into force by S.I. 1989/337 for some purposes on 7th March 1989 and for other purposes on 1st April 1989.
