The Local Government and Housing Act 1989 (Commencement No. 4) Order 1990

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred upon them by section 195(2) and (3) of the Local Government and Housing Act 1989(1) and of all other powers enabling them in that behalf, hereby make the following Order:

1. This Order may be cited as the Local Government and Housing Act 1989 (Commencement No. 4) Order 1990.

2. In this Order "the Act" means the Local Government and Housing Act 1989.

3. Section 194(1) of the Act, insofar as it relates to paragraph 4 of Schedule 11, shall come into force on 26th February 1990.

4. Section 164 of the Act shall come into force on 1st March 1990.

5.-(1) Section 165(3) to (9) of the Act and section 194(4), insofar as it relates to the repeal of sections 312 to 314 of, and Schedule 12 to, the Housing Act 1985(2) shall come into force on 1st March 1990.

(2) The repeal mentioned in paragraph (1) above does not have effect in relation to any financial year beginning before 1st April 1990.

Explanatory Note

(This note is not part of the Order)

Article 3 of the Order brings into force on 26th February 1990 paragraph 4 of Schedule 11 to the Local Government and Housing Act 1989 which inserts a new paragraph into Part II of Schedule 1 to the Education Act 1944 (c. 31). The new paragraph empowers the Secretary of State to give directions to local education authorities requiring specified education committees to include persons appointed in accordance with the directions.

Article 4 of the Order brings into force on 1st March 1990 section 164 of the Local Government and Housing Act 1989 (exception to the right to buy in case of certain dwelling-houses for persons of pensionable age).

Article 5(1) of the Order brings into force on 1st March 1990 section 165(3) to (9) of the 1989 Act which makes new provision for payment of slum clearance subsidy. The repeal of sections 312 to 314 of, and Schedule 12 to, the Housing Act 1985 which make existing provision for payment of slum clearance subsidy is brought into force but by virtue of article 5(2) does not have effect in relation to the financial years beginning before 1st April 1990, the date from which the new provisions will have effect.
