The Secretary of State, being the Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the measures for safety and consumer protection as respects electrical equipment and any provisions concerning the composition, labelling, marketing, classification or description of electrical equipment, in the exercise of the powers conferred on him by that section, and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
1.-(1) These Regulations, which extend to Great Britain, may be cited as the Electrical Equipment for Explosive Atmospheres (Certification) (Amendment) Regulations 1990 and shall come into force on 31st December 1990.
(2) In these Regulations, "the principal regulations" means the Electrical Equipment for Explosive Atmospheres (Certification) Regulations 1990(3).
2. In regulation 2(1) of the principal regulations, in the definition of "the First Specific Directive", there shall be inserted at the end "and as amended by Council Directive No. 90/487/EEC(4)".

These Regulations amend regulation 2(1) of the Electrical Equipment for Explosive Atmospheres (Certification) Regulations 1990 (the principal regulations) to give effect with respect to Great Britain to the provisions of Council Directive 90/487/EEC (OJ No. L270, 2.10.90, p. 23) concerning electrical equipment for use in potentially explosive atmospheres employing certain types of protection . The principal regulations enable a manufacturer to apply to an appropriate certification body appointed under those regulations for a certificate attesting that the electrical equipment, the subject of the application, conforms to the harmonised standards as defined in the regulations or offers a degree of safety at least equivalent to those standards.
The effect of this amendment is to extend the list of the harmonised standards.
