CHANGES IN LOCAL GOVERNMENT AREAS

The City of Edinburgh, East Lothian and Midlothian Districts (Whitehill Mains) Boundaries Amendment Order 1990

Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1) the Local Government Boundary Commission for Scotland on 22nd May 1989 submitted to the Secretary of State a report on a review conducted under section 14(2) of that Act in which they made proposals for the transfer of certain areas between City of Edinburgh and East Lothian Districts and between East Lothian and Midlothian Districts, and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Title and commencement

1. This Order may be cited as the City of Edinburgh, East Lothian and Midlothian Districts (Whitehill Mains) Boundaries Amendment Order 1990, and shall come into force on 1st April 1990.

Interpretation

2. In this Order-�

"the 1977 Regulations" means the Local Government Area Changes (Scotland) Regulations 1977(2); and

"boundary map" means the map prepared by the Scottish Office marked "The City of Edinburgh, East Lothian and Midlothian Districts (Whitehill Mains) Boundaries Amendment Order 1990 Map" and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a boundary of a district is a reference to a boundary existing immediately before the commencement of this Order.

Application of the 1977 Regulations

3. Save insofar as they can have no application in relation to the area changes effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area changes

4.-(1) Part of East Lothian District, being the area A described in the Schedule to this Order and shown delineated, hatched and marked "Area A" on the boundary map, shall be transferred to Midlothian District.

(2) Part of Midlothian District, being the area B described in the Schedule to this Order and shown delineated, hatched and marked "Area B" on the boundary map, shall be transferred to East Lothian District.

(3) Part of East Lothian District, being the area C described in the Schedule to this Order and shown delineated, hatched and marked "Area C" on the boundary map, shall be transferred to the City of Edinburgh District.

(4) Part of the City of Edinburgh District, being the area D described in the Schedule to this Order and shown delineated, hatched and marked "Area D" on the boundary map, shall be transferred to East Lothian District.

Consequential changes of electoral arrangements

5.-(1) Area A described in the Schedule to this Order (being the area transferred by article 4(1) of this Order)-�

(a)shall cease to form part of electoral division 45 (Musselburgh) of Lothian Region(3) and of ward 3 (Musselburgh South) of East Lothian District(4); and

(b)shall form part of electoral division 43 (Dalkeith) of Lothian Region and of ward 10 (Dalkeith/Newton) of Midlothian District(5).

(2) Area B described in the Schedule to this Order (being the area transferred by article 4(2) of this Order)-�

(a)shall cease to form part of electoral division 43 (Dalkeith) of Lothian Region and of ward 10 (Dalkeith/Newton) of Midlothian District; and

(b)shall form part of electoral division 45 (Musselburgh) of Lothian Region and of ward 3 (Musselburgh South) of East Lothian District.

(3) Area C described in the Schedule to this Order (being the area transferred by article 4(3) of this Order)-�

(a)shall cease to form part of electoral division 45 (Musselburgh) of Lothian Region and of ward 3 (Musselburgh South) of East Lothian District; and

(b)shall form part of electoral division 39 (Niddrie/Craigmillar) of Lothian Region and of ward 61 (Niddrie) of the City of Edinburgh District(6).

(4) Area D described in the Schedule to this Order (being the area transferred by article 4(4) of this Order)-�

(a)shall cease to form part of electoral division 39 (Niddrie/Craigmillar) of Lothian Region and of ward 61 (Niddrie) of the City of Edinburgh District; and

(b)shall form part of electoral division 45 (Musselburgh) of Lothian Region and of ward 3 (Musselburgh South) of East Lothian District.

SCHEDULE

Area A

The area bounded by a line commencing on the City of Edinburgh/East Lothian District boundary on the west side of the Musselburgh bypass at a point grid reference NT 3187 7153; southeastwards along the southwestern boundary of the said bypass to a point grid reference NT 3208 7147 being the intersection of the fence bounding the said bypass and the fence bounding the eastern side of railway land lying to the north of Millerhill Marshalling Yard; then southeastwards by fence and treeline bounding the east side of said railway land to a point grid reference NT 3219 7133; then eastwards along the north side of Whitehill Road to a point grid reference NT 3233 7132; then generally southeastwards along a fence and treeline bounding the said Millerhill Marshalling Yard to a point grid reference NT 3265 7026; then generally northwestwards along the East Lothian/Midlothian district boundary to its intersection with the City of Edinburgh/East Lothian district boundary at a point grid reference NT 3171 7149; thereafter northeastwards along the said City of Edinburgh/East Lothian district boundary to the point of commencement.

Area B

The area bounded by a line commencing on the East Lothian/Midlothian district boundary at a point grid reference NT 3265 7026; eastwards and thereafter generally southeastwards along a fenceline and treeline bounding the railway land lying to the south of Millerhill Marshalling Yard to a point on the said district boundary grid reference NT 3300 7010; then generally northwestwards along that boundary to the point of commencement.

Area C

The area bounded by a line commencing on the City of Edinburgh/East Lothian district boundary at a point grid reference NT 3187 7153; southeastwards along the southwestern boundary of the Musselburgh bypass to a point grid reference NT 3208 7147 being the intersection of the fence bounding the said bypass and the fence bounding railway land lying to the north of Millerhill Marshalling Yard; then northwestwards in a straight line to a point grid reference NT 3204 7151 being the intersection of the said fence bounding railway land and the fence bounding the southern side of Newcraighall Public Park; then northeastwards along that fenceline bounding the southern side of Newcraighall Public Park and thereafter continuing by field fenceline and hedgeline to a point grid reference NT 3265 7175; then northwestwards by wall and fenceline to a point grid reference NT 3258 7190 on the City of Edinburgh/East Lothian district boundary, then generally southwestwards along the said boundary to the point of commencement.

Area D

The area bounded by a line commencing on the East Lothian/City of Edinburgh district boundary at a point grid reference NT 3258 7190; northwestwards by wall and fence boundary to a point grid reference NT 3257 7200; then northeastwards in a straight line crossing a dismantled railway line and the main East coast railway line to a point on the said district boundary, grid reference NT 3258 7206; thereafter southeastwards, and then southwestwards always along that boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers on 1st April 1990 four adjacent areas amounting in total to approximately 64.2 hectares between East Lothian and Midlothian Districts, and between East Lothian and the City of Edinburgh Districts, and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order.

Copies of the detailed boundary map defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order and may be inspected at, or purchased from, the Scottish Development Department's Map Library, New St. Andrew's House, St. James Centre, Edinburgh, EH1 3SZ.

The electoral divisions of Lothian Region were constituted by S.I. 1978/418, to which there are amendments not relevant to this Order.

The wards of Midlothian Districts were constituted by S.I. 1979/1097, to which there are amendments not relevant to this Order.
