The Motor Vehicles (Tests) (Amendment) Regulations 1990

The Secretary of State for Transport, in exercise of the powers conferred by sections 45 and 46 of the Road Traffic Act 1988(1) and by the Department of Transport (Fees) Order 1988(2), and of all other enabling powers, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:-�

1. These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) Regulations 1990 and shall come into force on 2nd April 1990.

2. The Motor Vehicles (Tests) Regulations 1981(3) shall be further amended in accordance with the provisions of these Regulations.

3. In regulation 20(4) for the Table there shall be substituted the following Table-�

"TABLE

FEES RELATING TO THE RE-EXAMINATION OF VEHICLES IN CLASS VI

Vehicles in Class VI constructed or adapted to carry more than 12 passengers

( )£17.75, if the vehicle is submitted for a further examination within 14 days of the date of the issue of the notice of refusal of a test certificate, or

(a)£31, in the circumstances described in paragraph (a) of the entry in column 2, or

(b)£38.00, in any other case.

(b)£62.50 in any other case.

Other vehicles in Class VI

(a)£13.25, if the vehicle is submitted for a further examination within 14 days of the date of the issue of the notice of refusal of a test certificate, or

(a)£22.25, in the circumstances described in paragraph (a) of the entry in column 2, or

(b)£26.50, in any other case.

(b)£44.50, in any other case.".

4. In the regulations specified in column 1 of the Table below for the amounts specified in column 2 of the Table there shall be specified the amounts specified in column 3 of the Table.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 ("the 1981 Regulations") in relation to Class VI vehicles (public service vehicles other than those of a type specified in regulation 5(3) as follows.

(a)The fee payable for an examination under regulation 12 of the 1981 Regulations of a vehicle constructed or adapted to carry more than 12 passengers is increased from £36.25 to £38.00. The Regulations do not affect the supplements to the fees payable for such examinations on Saturdays.

(b)The fee payable for the re-examination of a vehicle constructed or adapted to carry more than 12 passengers, within 14 days of the date of the issue of the notice of refusal of a test certificate, is increased from £17.75 to £18.75 and the fee for such a re-examination on a Saturday is increased from £30.00 to £31.00.

(c)The fee for the re-examination of any other vehicle, within 14 days of the date of the issue of the notice of refusal, is increased from £12.50 to £13.25 and the fee for such a re-examination on a Saturday is increased from £21.50 to £22.25.

(d)The fee payable for the re-examination of a vehicle constructed or adapted to carry more than 12 passengers, later than 14 days from the issue of the notice of refusal, is increased from £36.25 to £38.00 and the fee for such an examination on a Saturday is increased from £60.75 to £62.50.

(e)The fee payable for the re-examination of any other vehicle, later than 14 days from the issue of the notice of refusal, is increased from £25.25 to £26.50 and the fee for such an examination on a Saturday is increased from £43.25 to £44.50.

(f)The fee payable for the issue of a duplicate test certificate is increased from £7.75 to £8.25.
