The Betting, Gaming and Lotteries Act 1963 (Variation of Fees) (Scotland) Order 1991

The Secretary of State, in exercise of the powers conferred on him by sections 42(2) and 45(2) of, and paragraph 26 of Part II of Schedule 4 to, the Local Government (Scotland) Act 1966(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1. This Order may be cited as the Betting, Gaming and Lotteries Act 1963 (Variation of Fees) (Scotland) Order 1991 and shall come into force on 2nd December 1991.

2. The sum specified in paragraph 11 of Schedule 2 to the Betting, Gaming and Lotteries Act 1963(2) (fees in respect of registration as a registered pool promoter) shall, instead of £350, be £464.

3. The sum specified in paragraph 12(1) of Schedule 3 to the Betting, Gaming and Lotteries Act 1963(3) (fees in respect of application for a track betting licence) shall, instead of £35, be £46.

4. The sum specified in paragraph 12(2) of Schedule 3 to the Betting, Gaming and Lotteries Act 1963(4) (fees in respect of track betting licence) shall, instead of £350, be £464.

5. The sum specified in paragraph 12(3) of Schedule 3 to the Betting, Gaming and Lotteries Act 1963(5) (fees in respect of transfer of track betting licence) shall, instead of £35, be £46.

6. The Betting, Gaming and Lotteries Act 1963 (Variation of Fees) (Scotland) Order 1982(6) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order increases the maximum amount of certain fees payable under the Betting, Gaming and Lotteries Act 1963.

The maximum amount which may be fixed by the appropriate registering authority as the registration fee and continuation fee payable by a registered pool promoter is increased from £350 to £464. The maximum amounts which may be fixed by the appropriate licensing authority as fees in respect of any application for a track betting licence, the licence itself and any transfer of such a licence are increased from £35 to £46, £350 to £464 and £35 to £46 respectively.
