The Secretary of State, in exercise of the powers conferred on him by sections 3(2) and 94(1) of the Social Work (Scotland) Act 1968((1)), and of all other powers enabling him in that behalf, hereby makes the following regulations:-
1. These Regulations may be cited as the Qualifications of Directors of Social Work (Scotland) Amendment Regulations 1993 and shall come into force on 1st April 1993.
2. In these Regulations, "the principal Regulations" means the Qualifications of Directors of Social Work (Scotland) Regulations 1978((2)).
3. In regulation 2 (interpretation) of the principal Regulations, for paragraph (1) there shall be substituted the following paragraph-
"(1) In these Regulations, unless the context otherwise requires-
"the 1962 Act" means the Health Visiting and Social Work (Training) Act 1962((3));
"the 1983 Act" means the Health and Social Services and Social Security Adjudications Act 1983((4));
"the Council" means the Central Council for Education and Training in Social Work constituted by section 1 of the 1962 Act((5)) and continued in being by section 10 of the 1983 Act((6)).".
4. In regulation 3 (qualifications of directors of social work) of the principal Regulations-
(a)for paragraph (a) there shall be substituted the following paragraph-
"(a)attainment of one of the following qualifications-
(i)the Certificate of Qualification in Social Work,
(ii)the Certificate in Social Services, or
(iii)the Diploma in Social Work,
of the Council awarded in accordance with rules made under section 3 of the 1962 Act or, as the case may be, section 10 of the 1983 Act; or";
and
(b)at the end of paragraph (b) there shall be added the word "; or".

These Regulations amend the Qualifications of Directors of Social Work (Scotland) Regulations 1978, which prescribe the qualifications to be held by persons appointed to the office of director of social work under Part I of the Social Work (Scotland) Act 1968 by regional and islands councils. The Regulations add to the range of prescribed qualifications the Certificate in Social Services and the Diploma in Social Work, and make a minor drafting amendment.
1968 c. 49; section 94(1) contains a definition of "prescribed" relevant to the exercise of the statutory powers under which these Regulations are made; that definition was inserted by the Children and Young Persons Act 1969 (c. 54), Schedule 5, paragraph 64(1).

Section 1 was amended by section 11 of the Local Authority Social Services Act 1970 (c. 42).
The 1962 Act was repealed by the 1983 Act, Schedule 10.
