The Bovine Offal (Prohibition) (England, Wales and Scotland) (Revocation) Regulations 1995

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in relation to England and Wales, and the Secretary of State for Scotland in relation to Scotland, in exercise of the powers conferred on them by sections 6(4), 16(1)(a), (b), (c), (d), and (f), (2) and (3), 26(3) and 48(1) of, and paragraph 3(1) of Schedule 1 to, the Food Safety Act 1990(1) and of all other powers enabling them in that behalf, after consultation in accordance with section 48(4) of the said Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations, hereby make the following Regulations:

Title and commencement

1. These Regulations may be cited as the Bovine Offal (Prohibition) (England, Wales and Scotland) (Revocation) Regulations 1995 and shall come into force on 15th August 1995.

Revocations

2. The Regulations specified in columns 1 and 2 of the Schedule to these Regulations are hereby revoked to the extent specified in column 3 of that Schedule.

Amendment

3. After the definition of "scientific purposes" in regulation 2(1) of the Animal By-Products (Identification) Regulations 1995(2) there shall be inserted the following-

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which extend to Great Britain, come into force on 15th August 1995.

The Regulations revoke in their entirety the Bovine Offal (Prohibition) Regulations 1989 (S. 1989/2061">1989/2061) (as amended) and the Bovine Offal (Prohibition) (Scotland) Regulations 1990 (S. 1990/112">1990/112) (as amended), which control specified bovine offal (regulation 2 and Schedule). Specified bovine offal is now controlled by the Specified Bovine Offal Order 1995, which comes into force on the same day as these Regulations ("the SBO Order").

The Regulations also make some consequential revocations (regulation 2 and Schedule).

The Regulations also amend the Animal By-Products (Identification) Regulations 1995 (S. 1995/614">1995/614), which cross-refer to the definition of specified bovine offal contained in the Bovine Offal (Prohibition) Regulations 1989, by inserting a new definition of specified bovine offal identical to that in the SBO Order (regulation 3).
