CHANGES IN LOCAL GOVERNMENT AREAS

The Secretary of State, in exercise of this powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect, with modifications, to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
1.-(1) This Order may be cited as the Kensington and Chelsea and Hammersmith and Fulham (London Borough Boundaries) Order 1995.
(2) This Order shall come into force for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2) on 1st February 1996.
(3) For all other purposes, this Order shall come into force on 1st April 1996.
2. In this Order-
"Chelsea" means Royal Borough of Kensington and Chelsea;
"Fulham" means the London Borough of Hammersmith and Fulham;
"the map" means one or more of the 5 maps prepared by the Department of the Environment, marked "Maps of the Kensington and Chelsea and Hammersmith and Fulham (London Borough Boundaries) Order 1995", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976; and
"ward" means a ward of the London borough from or to which an area is transferred(3)
3.-(1) Each area which is marked as shown in column 1 of the following Table on the map indicated in column 2 shall be transferred from Chelsea, and from the ward named in column 3 to Fulham, to the ward named in column 4 and to the West London petty sessional division and the Greater London Western coroners district.

4.-(1) In this article "provision" means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(4)).
(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.
5. So much of the Wandon Road Estate as is, at the date of making this Order, in Chelsea, and which is transferred by this Order to Fulham, is hereby specified in relation to regulation 62(1)(b) of the Local Government Area Changes Regulations 1976.

(This Note is not part of the Order)
This Order makes changes within Greater London to the boundary of the Royal Borough of Kensington and Chelsea ("Chelsea") with the London Borough of Hammersmith and Fulham ("Fulaham"). Consequential changes are made to borough ward boundaries and to the boundaries of petty sessional areas and coroner's districts. The order also provides for so much of the Wandon Road Estate as is, at the date of making the Order in Chelsea, to be retained property for the purposes of regulation 62(1)(b) of the Local Government Area Changes Regulations 1976 (S.I. 1976/246) ("the 1976 Regulations").
The map and table at the end of this Note give a general guide to the areas affected. In approximate terms, the total area of land transferred from Chelsea to Fulham is 4.4 hectares (population of 154), and that transferred from Fulham to Chelsea is 17 hectares (population of 1,078). For full details of the transfers made, the order maps (described in article 2) should be inspected. Any person may inspect them at any reasonable time at the offices of the council for either of the boroughs affected, and also at the offices of the Secretary of State for the Environment located in 2 Marsham Street, London, SW1P 3EB.
The 1976 Regulations (amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
1. Realignment to the eastern side of the West London railway line in the following vicinities-
(i)River Thames/Fulham Road/Brompton Cemetery/Old Brompton Road; and
(ii)the northern side of the West Cromwell Road/Kensington High Street/Shepherd's Bush Green/West Cross Route/Bard Road/Latimer Road/Latimer Road/Bracewell Road/Little Wormwood Scrubs.
These realignments involve transfers of property in or near Queensdale Crescent, Hunt Street, Freston Road and Bracewell Road.
2. Realignment to unit Little Wormwood Scrubs in Hammersmith and Fulham.
Areas as from 1st April 1996
1972 c. 70. Sections 46 to 52 inclusive of this Act were repealed by the Local Government Act 1992 (c. 19) but are continued in effect by section 24(3) of the 1992 Act where any report or proposals were submitted by the Commission to the Secretary of State under Part IV of the 1972 Act before 31st October 1992.

Every district (including a London borough) is divided into wards for the purposes of the election of district councillors (sections 6(2)(b) and (c) of the Local Government Act 1972.
