Whereas a draft of the following Order was laid before Parliament, and approved by resolution of each House of Parliament:
Now, therefore, Her Majesty, in exercise of the power conferred on Her by section 2(4) of the Supreme Court Act 1981(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: -
1. This Order may be cited as the Maximum Number of Judges Order 1996 and shall come into force on the day after the day on which it is made.
2. Section 2(1) of the Supreme Court Act 1981(2), prescribing the maximum number of ordinary judges of the Court of Appeal, shall be amended so as further to increase the maximum number to 35.

This Order in Council amends the Supreme Court Act 1981 by increasing the maximum number of ordinary judges of the Court of Appeal from 32 to 35.
