This Statutory instrument has been made in consequence of defects in S.I. 1996/2887, 2890 and 2891, and is being issued free of charge to all known recipients of those Statutory Instruments.

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred upon them by sections 2(2) and (4), 3(3) and (4), 30, 31(5), 79, 101(1) and 146(1) and (2) of the Housing Grants, Construction and Regeneration Act 1996(2) and of all other powers enabling them in that behalf, and with the consent of the Treasury, hereby make the following Regulations-
1.-(1) These Regulations may be cited as the Housing Renewal Grants and Home Repair Assistance (Amendment) Regulations 1996 and shall come into force on 17th December 1996.
(2) In these Regulations-
"the Home Repair Assistance Regulations" means the Home Repair Assistance Regulations 1996(3);
"the Prescribed Form Regulations" means the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996(4);
"the Renewal Grants Regulations" means the Housing Renewal Grants Regulations 1996(5)
2. In paragraph 4 of Part I of Schedule I to the Home Repair Assistance Regulations (content of application: general), after "income support," insert "an income-based jobseeker's allowance (which has the same meaning as in section 1(4) of the Jobseekers Act 1995(6)".
3. The Renewal Grants Regulations shall be amended as follows:-
(a)in regulation 10(2)(a)(the applicable amount), after "income support", insert "or an income-based jobseeker's allowance"; and
(b)from paragraph 6 (concessionary payments) of Schedule 3 (sums to be disregarded in the determination of income other than earnings), omit sub-paragraph (c).
4. The Schedule to the Prescribed Form Regulations (prescribed form for owner-occupier's and tenant's applications for housing renewal grants) shall be amended as follows:-
(a)in each of the following, namely-
(i)in footnote (c) immediately preceding Part I of the form in the Schedule, in the second paragraph of that footnote,
(ii)in note 17, in the second paragraph, and
(iii)in note 41, in the first paragraph,
for "in Annex J2 to Circular 17/96", substitute ", as respects England, in Annex J2 to Department of the Environment Circular 17/96 or, as respects Wales, in Annex J2 to Welsh Office Circular 59/96";
(b)in each of the following, namely-
(i)in question 3.1, and
(ii)in question 3.22,
for "receiving", substitute "entitled to and receiving"; and
(c)in note 17, in the second paragraph, for "the form in the Schedule", substitute "this form".

These Regulations make a small number of corrections and drafting changes to the Home Repair Assistance Regulations (S.I. 1996/2887), the Housing Renewal Grants Regulations (S.I.1996/2890) and the Housing Renewal Grants (Prescribed Form and Particulars) Regulations 1996 (S.I. 1996/2891) and come into force together with all those Regulations on 17th December 1996.
