The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (London Boroughs of Newnham and Southwark) Order 1997 and shall come into force on 28th March 1997.
2. The management of sports and leisure facilities by the London Borough of Newnham shall not be treated as a defined activity so long as it is undertaken at the Royal Victoria Dock Water Sports Centre, Tidal Basin Road, Off Silvertown Way, London E16 1AF, before 31st December 1998.
3. The management of sports and leisure facilities by the London Borough of Southwark shall not be treated as a defined activity so long as-
(a)it is undertaken at the Peckham Pulse Leisure Centre, 10, Melon Road, Peckham, London, SE15 5QW;
(b)it consists of the marketing and promotion of the facility, the taking of bookings, and the collection of, and accounting for, fees and charges; and
(c)it is carried out before 1st September 1999.

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
This Order exempts from the requirements of Part I the management of sports and leisure facilities by the London Borough of Newham so long as it is undertaken at the sites named in the Order before 31st December 1998 and by the London Borough of Southwark so long as it is undertaken at the site named in the Order before 1st September 1999.
