The Secretary of State, in exercise of the powers conferred by section 2(2) of the Fossil Fuel Levy Act 1998(1), hereby makes the following Order:-
1. This Order may be cited as the Fossil Fuel Levy Act 1998 (Commencement) Order 1998.
2. The Fossil Fuel Levy Act 1998 shall come into force on 1st April 1998.

This Order brings into force all the provisions of the Fossil Fuel Levy Act 1998 ("the 1998 Act"). The 1998 Act amends section 33 of the Electricity Act 1989 (c. 29) so that all electricity which is generated by generating stations fuelled by nuclear fuel and which is supplied by persons licensed to supply electricity under the Electricity Act 1989 ("the 1989 Act") is subject to the fossil fuel levy. Section 1(3) of the 1998 Act inserts a new subsection (9) in section 33 of the 1989 Act which gives the Secretary of State the power to make regulations which will extend the fossil fuel levy to all electricity supplied by persons licensed to supply electricity under the 1989 Act.
