NORTHERN IRELAND

The Public Processions (Northern Ireland) Act 1998 (Guidelines) Order 1999

Coming into force

Whereas-�

(1) in pursuance of subsection (2)(a) of section 5 of the Public Processions (Northern Ireland) Act 1998(1) ("the 1998 Act") the Parades Commission for Northern Ireland ("the Commission") is required to keep under review the set of guidelines ("the guidelines") issued under that section as to the exercise of its functions under section 8 of the 1998 Act;

(2) in pursuance of subsection (2)(b) of that section the Commission may from time to time revise the whole or any part of the guidelines and issue the revised guidelines;

(3) in pursuance of paragraph 5 of Schedule 2 to the 1998 Act the Commission has prepared and published a draft of revised guidelines, has considered representations made to it about the draft, and has modified the draft accordingly;

(4) in pursuance of paragraphs 6 and 7 of Schedule 2 to the 1998 Act the Commission has sent the draft of the revised guidelines to the Secretary of State, who has laid the draft before each House of Parliament:

And whereas a draft of this Order has been approved by resolution of each House of Parliament:

Now, therefore, the Secretary of State, in exercise of the powers conferred on her by paragraph 8 of Schedule 2 to the 1998 Act, hereby orders as follows:

Citation and Commencement

1. This Order may be cited as the Public Processions (Northern Ireland) Act 1998 (Guidelines) Order 1999 and shall come into force on 31st July 1999.

Revised Guidelines

2. The revised guidelines laid in draft before Parliament on 30th June 1999 as to the exercise by the Commission of its functions under section 8 of the 1998 Act shall come into operation on 31st July 1999.

3. The Public Processions (Northern Ireland) Act 1998 (Guidelines) Order 1998(2) (which brought into operation the draft guidelines laid before Parliament on 23rd February 1998) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order appoints 31st July 1999 as the date on which the revised guidelines relating to the exercise by the Parades Commission for Northern Ireland ("the Commission") of its functions under section 8 of the Public Processions (Northern Ireland) Act 1998 ("the 1998 Act") (power to impose conditions on public processions) are to come into operation.

The revised guidelines, which are issued by the Commission under section 5 of the 1998 Act, replace the guidelines brought into operation on 3rd March 1998 by the Public Processions (Northern Ireland) Act (Guidelines) Order 1998 (which is revoked by this Order).

The revised guidelines are published by the Commission and copies may be obtained from the Commission at 12th Floor, Windsor House, Bedford Street, Belfast BT2 7EL.
