Whereas an application has been made by notice dated 8th February 1999 to the Secretary of State under section 3(1) of the School Teachers' Pay and Conditions Act 1991 ("the Act")(1) by the governing body of Islamia Primary School, Brent, which on that date was a grant-maintained school, for exemption from pay and conditions orders;
And the Secretary of State and the governing body of Islamia Primary School, Brent have agreed on 15th November 1999 as the date from which the governing body should make their own provision as to the statutory conditions of employment of the school teachers employed by them;
Now, therefore, in performance of the duty under section 3(4) of the Act, the Secretary of State for Education and Employment hereby makes the following Order-
1. This Order may be cited as the Education (Islamia Primary School, Brent) (Exemption from Pay and Conditions) Order 1999 and shall come into force on 15th November 1999.
2. With effect from 15th November 1999, subsections (6) and (7) of section 2 of the Act shall not apply to the statutory conditions of employment of the school teachers in Islamia Primary School, Brent.

This Order, made under section 3(4) of the School Teachers' Pay and Conditions Act 1991 ("the Act"), comes into force on 15th November 1999. With effect from that date, section 2(6) and (7) of the Act, which provides that the statutory conditions of employment of school teachers (their remuneration and such of their other conditions of employment as relate to their professional duties and working time) are governed by pay and conditions orders made under section 2(1) of that Act, shall no longer apply to the statutory conditions of employment of school teachers in Islamia Primary School, Brent.
With effect from 1st September 1998 a new section 3 of the Act was substituted by section 13 of the School Standards and Framework Act 1998. The School Standards and Framework Act 1998 (School Teachers' Pay and Conditions) (Transitional Provisions) Regulations 1998 (S.I. 1998/2115) made transitional provision so as to allow the Secretary of State to continue to make orders under section 3 as in force immediately before the amendment in respect of applications received by him before 31st March 1999.
1991 c. 49. A new section 3 was substituted by section 13 of the School Standards and Framework Act 1998 (c. 31) but by virtue of S.I. 1998/2115 that amendment does not affect the operation of section 3 (as in force immediately before the amendment) in relation to the making of an order under section 3 pursuant to an application for exemption under section 3(1) received by the Secretary of State before 31st March 1999.
