The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2) Order 1998 Partial Revocation Order 1999

Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 2) Order 1998 Partial Revocation Order 1999 and shall come into force at 18.00 hours on 4th March 1999.

Revocation

2. The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No. 2) Order 1998(2) is revoked insofar as it designates any part of the area set out in the Schedule to this Order.

Article 2

SCHEDULE

The area of sea to the east of the Orkney Islands bounded by a line extending from a point at 59° 15'N 2° 30'W then due east to a point at 59° 15'N 1° 30'W then due south to a point at 59°N 1° 30'W then due west to a point at 59°N 2° 30'W then due north to the start point.

Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.2) Order 1998 ("the principal Order") which prohibited-�

(a)fishing for or taking scallops within the area designated in the Schedule to that Order (article 4);

(b)movement of such scallops out of that area (article 5); and

(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated area within the United Kingdom (article 6).

The effect of this Order is to remove the prohibitions in respect of the area of sea designated in the Schedule to this Order. The prohibitions remain in force in respect of the remainder of the area of sea described in the Schedule to the principal Order.
