The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the former Southern Derbyshire Health Authority resulting from the establishment of the Southern Derbyshire Acute Hospitals National Health Service Trust(2), having consulted the Southern Derbyshire Health Authority and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
1.-(1) This Order may be cited as the Southern Derbyshire Acute Hospitals National Health Service Trust (Transfer of Trust Property) Order 1999 and shall come into force on 1st April 1999.
(2) In this Order-�
"the Authority" means the Southern Derbyshire Health Authority;
"the Trust" means the Southern Derbyshire Acute Hospitals National Health Service Trust;
"the trust property" means the property specified in a schedule of trust property prepared by, agreed upon by and signed on behalf of the Authority and the Trust on 13th August 1998.
2. On 1st April 1999 the trust property shall be transferred from the Authority to the Trust.

This Order transfers to the Southern Derbyshire Acute Hospitals National Health Service Trust on 1st April 1999 trust property the title to which is vested in Southern Derbyshire Health Authority. A copy of the schedule of trust property to which the Order refers can be obtained from the Department of Health, Accounts and Trust Allocations Branch, Quarry House, Quarry Hill, Leeds LS2 7UE.
1977 c. 49; section 92 has been amended by section 11(5) of the National Health Service and Community Care Act 1990 (c. 19) and by paragraph 44 of Schedule 1 to the Health Authorities Act 1995 (c. 17).
