In exercise of powers conferred on the Secretary of State by sections 537 and 569(4) and (5) of the Education Act 1996(1), and after consulting with those persons with whom consultation appeared to him to be desirable, the Secretary of State for Education and Employment hereby makes the following Regulations:
1. These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) Regulations 2000, and shall come into force on 15th May 2000.
2. For Regulation 9 of the Education (School Performance Information) (England) Regulations 1999(2), there shall be substituted-
9.-(1) Subject to paragraph (2), the governing body of every maintained school and the proprietor of every non-maintained special school or independent school shall, within two weeks of receiving a written request by the Secretary of State, provide him with the information for the reporting school year specified in Schedule 4.
(2) This regulation does not apply in respect of a school providing education for boarding pupils only."

These Regulations replace regulation 9 of the Education (School Performance Information) (England) Regulations 1999 ("the principal Regulations") which relate to the collection and publication of information about the performance of schools.
The substituted regulation 9 requires the governing body of every maintained school to provide the information referred to in Schedule 4 of the principal regulations directly to the Secretary of State within two weeks of receiving a written request from him. This replaces the duty under the old regulation 9 to provide that information to the local education authority, and the authority's duty to pass this on to the Secretary of State.
The substituted regulation preserves the duty on the proprietor of a non-maintained special school or an independent school to provide the same information to the Secretary of State.
1996 c. 56; by virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the powers conferred by these provisions are exercisable by the Secretary of State only in relation to England. Section 537 has been amended by paragraph 37 of Schedule 7 to the Education Act 1997 (c. 44) and paragraph 152 of Schedule 30 to the School Standards and Framework Act 1998 (c. 31).
