The Education (Mandatory Awards) Regulations 2001 (Amendment) (No. 4) Regulations 2002

The Secretary of State for Education and Skills, in exercise of the powers conferred by sections 1 and 4(2) of, and paragraphs 3 and 4 of Schedule 1 to, the Education Act 1962[1], and by sections 3(1) and (3) of the Education Act 1973[2], hereby makes the following Regulations:

     1. These Regulations may be cited as the Education (Mandatory Awards) Regulations 2001 (Amendment) (No. 4) Regulations 2002 and shall come into force on 20th February 2002.

    
2. The Education (Mandatory Awards) Regulations 2001 (Amendment) (No. 3) Regulations 2002[3] are hereby revoked.

     3. The Education (Mandatory Awards) Regulations 2001[4] shall be amended in accordance with these Regulations.

     4. For paragraph 14(2) of Schedule 2 there shall be substituted -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations revoke the Education (Mandatory Awards) Regulations 2001 (Amendment) (No. 3) Regulations 2002, which contained a drafting defect.

These Regulations amend paragraph 14(2) of Schedule 2 of the Education (Mandatory Awards) Regulations 2001.

Where a student's academic year begins in the autumn he shall be eligible for 85 per cent. of dependants requirement for childcare costs for a period of 40 weeks beginning on the first day of the first term of that year.

Where a student's academic year begins in the winter, spring or summer he shall be eligible for 85 per cent. of dependants requirement for childcare costs for each week of each term of the year and Christmas and Easter vacations.

For any other week of the academic year a student shall be eligible for 70 per cent., of dependants requirement for childcare costs, except for any week that falls between the end of his course of study and the end of the academic year in which the course ends.
