The Nitrate Sensitive Areas (Amendment) Regulations 2002

The Secretary of State for Environment, Food and Rural Affairs, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred upon her by that section and all other powers enabling her in that behalf, hereby makes the following Regulations:

Title and commencement
     1. These Regulations may be cited as the Nitrate Sensitive Areas (Amendment) Regulations 2002 and shall come into force on 10th April 2002.

Interpretation
    
2. In these Regulations "the principal Regulations" means the Nitrate Sensitive Areas Regulations 1994[3].

Amendment of the principal Regulations
     3. Schedule 6 to the principal Regulations shall be amended, by the substitution -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the Nitrate Sensitive Areas Regulations 1994 as amended, which make provision for payments of aid to farmers in nitrate sensitive areas and determine the rates of payment in accordance with Article 5.1(b) of Council Regulation (EEC) No 2078/92 (OJ No. L215, 30.7.92, p.85). By virtue of Article 55(3) of Council Regulation (EC) No. 1257/1999 (OJ No. L160, 26.6.1999, p.80), which repealed Council Regulation (EEC) No 2078/92, the latter Regulation continues to apply to "actions approved by the Commission" before 1st January 2000.

These Regulations vary, with effect from 10th April 2002, the annual payment rates of certain options under the Basic Scheme and the Premium Arable Scheme (regulation 3).

No regulatory impact assessment has been prepared in respect of these Regulations.
