DERELICT LAND

The Derelict Land Clearance Area (Combe Down Stone Mines, Bath) Order 2002

The Secretary of State, in exercise of powers conferred upon him by section 1(7) and (8)(b) of the Derelict Land Act 1982[1] and of all other powers enabling him in that behalf, and with the consent of the Treasury, hereby makes the following Order:

Citation and commencement
     1. This Order may be cited as the Derelict Land Clearance Area (Combe Down Stone Mines, Bath) Order 2002 and shall come into force on 30th August 2002.

2.  - (1) Subsections (1) to (6) of section 1 of the Derelict Land Act 1982 shall have effect in relation to land in the locality shown bounded by the outside edge of a bold black line on the map as they have effect in relation to land in a development or intermediate area.

    (2) In paragraph (1), "the map" means the map marked "Map referred to in the Derelict Land Clearance Area (Combe Down Stone Mines, Bath) Order 2002" and signed by authority of the Secretary of State, which has been prepared in duplicate and of which one duplicate has been deposited, and is available for inspection, at the offices of the Bath and North East Somerset Council and the other has been deposited, and is available for inspection, at the offices of the Secretary of State.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order specifies a locality in the wards of Bathavon South, Combe Down and Lyncombe in the district of Bath and North East Somerset as a derelict land clearance area. It is a locality where underground stone mining has caused actual and apprehended collapse of land. In derelict land clearance areas, the Secretary of State can pay grant under the Derelict Land Act 1982 (towards the cost of acquiring, surveying and carrying out works on land which is derelict, neglected or unsightly) at the higher rates applicable to development and intermediate areas under that Act.

The locality specified is shown on the map referred to in article 2. A copy of the map is available for inspection at all reasonable times at the offices of the Bath and North East Somerset Council, Trimbridge House, Trim Street, Bath BA1 2DP and the Office of the Deputy Prime Minister, Eland House, Bressenden Place, London SW1E 5DU. Copies can be obtained from the Office of the Deputy Prime Minister, Zone 1/D2, Eland House, Bressenden Place, London SW1E 5DU.
