CORONERS

The Derbyshire (Coroners' Districts) (Amendment) Order 2005

  Made 19th December 2005 
  Laid before Parliament 21st December 2005 
  Coming into force 1st February 2006 

The council of the county of Derbyshire submitted to the Secretary of State a draft Order in compliance with section 4(2) of the Coroners Act 1988[1] and the Coroners (Orders as to Districts) Rules 1927[2] providing for the alteration of coroners' districts in the county of Derbyshire.

     The Secretary of State has made such modifications of the draft as he thinks fit and makes the following Order in exercise of the powers conferred by section 4(2) of the Coroners' Act 1988:

Citation, commencement and application
     1. —(1) This Order may be cited as the Derbyshire (Coroners' Districts) (Amendment) Order 2005.

    (2) This order shall come into force on 1st February 2006.

    (3) This Order shall not have effect in relation to any inquest begun before the day on which it comes into force or to any post-mortem examination which, before that day, a coroner has directed or requested a medical practitioner to make.

Amendment to the Derbyshire (Coroner's Districts) Order 1974
    
2. The existing High Peak Coroner's District and Scarsdale Coroner's District, as set out in the Schedule to the Derbyshire (Coroner's Districts) Order 1974[3] ("the 1974 Order"), shall be amalgamated to form a single Coroner's District called The North Derbyshire Coroner's District.

     3. In the Schedule to the 1974 Order for the coroners districts High Peak Corner and Scarsdale listed in column 1 and the corresponding areas listed in column 2 substitute—

"North Derbyshire Coroner's District The District of Bolsover and North East Derbyshire. The Boroughs of Chesterfield and High Peak.
           In the Borough of Amber Valley the parishes of Denthick, Lea and Holloway, South Wingfield and Alfreton.
           The District of Derbyshire Dales except the parishes in the Derby and South Derbyshire Coroner'' District."

EXPLANATORY NOTE

(This note is not part of the Order)


The county of Derbyshire was divided into four coroners' districts by the Derby (Coroners' Districts) Order 1974. Two of these districts were amalgamated by the Derbyshire (Coroners' Districts (Amendment) Order 1979. This Order deals with the remaining two districts not covered by the 1979 Order.

This Order creates one new coroners' district, out of the existing coroners' district of High Peak and Scarsdale, to be named North Derbyshire. The area of that district is set out in the substitution to the Schedule to the 1974 Order and is the only district which is wholly within the county of Derbyshire.
