EXPLANATORY NOTE

(This note is not part of the Order)

This Order declares the Partnership and Cooperation Agreement Establishing a Partnership between the European Communities and their Member States and the Republic of Tajikistan, signed on 11th October 2004, to be a Community Treaty as defined in section 1(2) of the European Communities Act 1972. The Agreement aims to consolidate and strengthen the European Communities' and their Member States' political, economic and trade relations with the Republic of Tajikistan, and promote democratic reforms, economic growth, sustainable development and action against poverty there. In addition, the Agreement includes clauses on human rights, action against terrorism and countering the proliferation of weapons of mass destruction.

The principal effect of declaring this Agreement to be a Community Treaty as so defined is that the provisions of section 2 of the European Communities Act 1972 (which provide for the general implementation of Community Treaties) apply to it.

A full Regulatory Impact Assessment has not been produced for this instrument as it has no impact on the costs of business, charities or voluntary bodies.
