The Gambling Act 2005 (Variation of Monetary Limit) Order 2009

The Secretary of State makes the following Order in exercise of the power conferred by section 99(11) of the Gambling Act 2005(1).

In accordance with section 355(6) of that Act a draft of this instrument was laid before and approved by a resolution of each House of Parliament.

Citation and commencement

1. This Order may be cited as the Gambling Act 2005 (Variation of Monetary Limit) Order 2009 and shall come into force on the day after the day the Order is made.

Variation of limit in section 99(3)(a) of the Gambling Act 2005

2. In section 99(3)(a) of the Gambling Act 2005 (which requires a monetary limit to be imposed on the proceeds of any lottery promoted in reliance on a lottery operating licence by a non-commercial society or local authority) for "£2,000,000" substitute "£4,000,000".

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends section 99(3)(a) of the Gambling Act 2005 ("the Act").

Section 99 of the Act (Mandatory conditions of lottery operating licence) contains certain requirements which the Gambling Commission must achieve by attaching conditions to lottery operating licences issued to non-commercial societies or local authorities. The requirements include monetary or percentage limits in relation to proceeds and prizes in lotteries run by such societies or authorities.

Section 99(3)(a) imposes a requirement that the proceeds of any lottery promoted in reliance on a lottery operating licence issued to a non-commercial society or local authority may not exceed £2,000,000.

Article 2 of this Order amends section 99(3)(a) by substituting £2,000,000 with £4,000,000.
