The Legal Services Act 2007 (Commencement No. 7) Order 2010

The Lord Chancellor makes the following Order in exercise of the powers conferred by section 211(2) of the Legal Services Act 2007(1).

Citation and interpretation

1.–(1) This Order may be cited as the Legal Services Act 2007 (Commencement No. 7) Order 2010.

(2) In this Order "the 2007 Act" means the Legal Services Act 2007.

Commencement of provisions

2. The following provisions of the 2007 Act, to the extent that they are not already in force, come into force on 2nd August 2010–

(a) section 25 (subject to the transitional provision previously made in relation to subsection (3)(a) and (b)), sections 75 to 79, section 83(3) to (7), section 157(3) and section 175(2)(c) and (d);

(b) Schedule 10;

(c) Schedule 11.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is the seventh commencement order made under the Legal Services Act 2007 (c. 29) ("the 2007 Act").

Article 2 brings into force on 2nd August 2010 provisions of the 2007 Act which are necessary to allow bodies (both existing approved regulators and new bodies) to submit applications to the Legal Services Board to be designated as licensing authorities prior to the commencement of the remainder of Part 5 of the 2007 Act.

The commencement of sections 25 and 83(3) to (7) and those provisions in Part 1 of Schedule 10 which are not already in force allows such applications to be made. The commencement of sections 75 to 79 and of Part 2 of Schedule 10 allows the Lord Chancellor to cancel a designation.

Schedule 11 makes provision as to the licensing rules which a body applying to the Legal Services Board for designation as a licensing authority must submit as proposed rules for approval.

Section 175(2)(c) and (d) provides that any application fee received by the Legal Services Board in respect of designation or cancellation of designation as an approved regulator must be paid into the Consolidated Fund.

Section 157(3) is commenced for the purpose of making transitional provision in due course.

An impact assessment has not been prepared for this Order but a full Regulatory Impact Assessment was prepared for the Legal Services Bill in November 2006, supplemented in June 2007. Copies of those documents are annexed to the Explanatory Memorandum which is available alongside this instrument on the OPSI website.
