The Secretary of State makes the following Order in exercise of the powers conferred by section 40(1) and (2) of the Horserace Betting and Olympic Lottery Act 2004(1):
1. This Order may be cited as The Horserace Betting and Olympic Lottery Act 2004 (Commencement No. 5) Order 2011.
2. The following provisions of the Horserace Betting and Olympic Lottery Act 2004 shall come into force on 13th July 2011:
section 13 but only to the extent that it relates to paragraphs 12, 13, 19, 21 and 22 of Schedule 2;
section 38 but only to the extent that it relates to the provisions of Schedule 6 specified below;
in Schedule 6 the repeal of section 17 of the National Lottery etc Act 1993(2), the whole of the Horserace Totalisator Board Act 1997(3), and in Part IV of Schedule 1 to the Freedom of Information Act 2000(4), "The Horserace Totalisator Board".

This Order brings into force certain provisions of The Horserace Betting and Olympic Lottery Act 2004 on 13th July 2011. Section 13 of that Act makes provision that certain consequential amendments in Schedule 2 shall have effect following the dissolution of the Horserace Totalisator Board (the Tote) and the transfer of its property, rights and liabilities to the successor company. Section 38 repeals certain enactments to the extent specified in Schedule 6. Schedule 2 and Schedule 6 of the Act have not been commenced fully because certain of the consequential amendments and repeals have been rendered obsolete by subsequent legislation or concern Part 2 of the Act (Abolition of the Horserace Betting Levy System).
