A draft of this Order has been laid before Parliament in accordance with section 1(3) of the European Communities Act 1972(1), and has been approved by a resolution of each House of Parliament.
Accordingly, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972, is pleased, by and with the advice of Her Privy Council, to order as follows:
1. This Order may be cited as the European Union (Definition of Treaties) (Stabilisation and Association Agreement) (Republic of Serbia) Order 2011.
2. It shall come into force on the date on which the treaty specified in the Schedule enters into force for the United Kingdom. This date will be notified in the London, Edinburgh and Belfast Gazettes.
3. The treaty specified in the Schedule is to be regarded as an EU Treaty as defined in section 1(2) of the European Communities Act 1972.

Article 2
The Stabilisation and Association Agreement between the European Communities and their Member States, of the one Part, and Republic of Serbia, of the other part, signed at Brussels on 29th April 2008(2).

This Order declares the Stabilisation and Association Agreement between the European Communities and their Member States and the Republic of Serbia, signed on 29th April 2008, to be an EU Treaty as defined in section 1(2) of the European Communities Act 1972.
The Agreement provides a framework for regular political dialogue between the parties and includes a commitment to promote regional co-operation and good neighbourly relations with the other countries of the region. It provides for the establishment of a free trade area over a transitional period, asymmetric trade preferences, assistance to support democratic, economic and institutional reforms and co-operation in the field of Justice and Home Affairs.
The principal effect of declaring this Agreement to be an EU Treaty so defined is that the provisions of section 2 of the European Communities Act 1972 apply to it.
A Regulatory Impact Assessment has not been produced for this instrument, as it has no impact on the costs to UK business, charities or voluntary bodies.
