The M40 Motorway (Junction 12 Improvements) Scheme 2014

The Secretary of State for Transport makes this scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980(1) and now vested in him(2).

1.  This scheme may be cited as the M40 Motorway (Junction 12 Improvements) Scheme 2014 and shall come into force on 25th September 2014.

2.  In this Scheme:

(1) All measurements of distance are measured along the route of the relevant highway.

(2) The following terms shall have the following meanings:

(i)"connecting road" means a special road along a route described in the Schedule to this Scheme;

(ii)"the plan" means the plan folio, marked "The M40 Motorway (Junction 12 Improvements) Scheme 2014", signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA; and

(iii)"the special roads" means each connecting road.

3.  The Secretary of State is authorised to provide the special roads for the exclusive use of traffic of Classes I and II of the classes of traffic set out in Schedule 4 to the Highways Act 1980.

4.  The centre line of each of the special roads is indicated by a heavy black line on the plan.

5.  Each of the special roads shall become a trunk road on the date when this Scheme comes into force.

Article 2

SCHEDULEROUTES OF THE CONNECTING ROADS

The routes of the slip roads are as follows:

(1) Junction with the B4451 (Gaydon Road) at Gaydon

Two routes connect the southbound carriageway of the M40 motorway with the B4451 (Gaydon Road) as proposed to be improved by the Secretary of State at Gaydon in Warwickshire (the special roads along these routes being respectively given the numbers 1 and 2 on the plan).

EXPLANATORY NOTE

(This note is not part of the Order)

This Scheme gives special road and trunk road status to two new slip roads, each about 0.3 kilometres in length, to be provided from the existing southbound carriageway of the M40 motorway to the signal controlled junction which the Secretary of State proposes to construct at the intersection with the B4451 (Gaydon Road).
