Coming into force in accordance with article 1(2)
The Chancellor of the Duchy of Lancaster, in exercise of the powers conferred by sections 54(1)(b) and 154(5)(b) of the Police Reform and Social Responsibility Act 2011(1), makes the following Order.
In accordance with section 7(1) and (2)(ha) of the Political Parties, Elections and Referendums Act 2000(2), the Chancellor of the Duchy of Lancaster has consulted the Electoral Commission before making this Order.
1.-(1) This Order may be cited as the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) Order 2015.
(2) It comes into force on the day after the day on which it is made.
(3) In this Order "police area" means a police area listed in Schedule 1 to the Police Act 1996 (police areas outside London)(3).
2.-(1) This article designates for the purposes of section 54(1)(b) of the Police Reform and Social Responsibility Act 2011 (returning officers etc) the person who is to be the police area returning officer for a police area in England listed in the table in Schedule 1 and the person who is to be the police area returning officer for a police area in Wales listed in the table in Schedule 2.
(2) In respect of a police area in England listed in the left-hand column of the table in Schedule 1, the police area returning officer is to be the person who is the acting returning officer for the corresponding parliamentary constituency listed in the right-hand column (being a constituency falling wholly or partly within that police area).
(3) In respect of a police area in Wales listed in the left-hand column of the table in Schedule 2, the police area returning officer is to be the person who is the acting returning officer for the corresponding parliamentary constituency listed in the right-hand column (being a constituency falling wholly or partly within that police area).
3. So far as it would relate to an election of a police and crime commissioner the poll for which takes place on or after 1st May 2016, the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) (No. 2) Order 2012(4) is revoked.

This Order designates for the purposes of section 54(1)(b) of the Police Reform and Social Responsibility Act 2011 (c. 13) the police area returning officers for the police areas in England listed in Schedule 1 and the police areas in Wales listed in Schedule 2. Article 3 revokes the existing designation order (S.I. 2012/2085) so far as that order relates to an election of a police and crime commissioner the poll for which is on or after 1st May 2016.
An impact assessment has not been prepared for this instrument as no impact on the private or voluntary sectors is foreseen.
2011 c. 13; powers of the Secretary of State under section 54(1)(b) are exercisable concurrently with the Chancellor of the Duchy of Lancaster by virtue of S.I. 2015/1376 so far as they concern an election for a police and crime commissioner the poll for which is on or after 1st May 2016.
2000 c. 41; paragraph (ha) was inserted by paragraph 11 of Schedule 10 to the Police Reform and Social Responsibility Act 2011. Other amendments have been made to subsection (2) but they are not relevant to this Order.
