The Secretary of State for Transport makes the following Order in exercise of the powers conferred by sections 1(1) and (2) and 2(1) to (3) of the Infrastructure Act 2015(1).
1. This Order may be cited as the Appointment of a Strategic Highways Company Order 2015 and comes into force on 1st April 2015.
2.-(1) Highways England Company Limited, incorporated in England and Wales under company number 9346363, ("the company") is appointed as a highway authority.
(2) The company is appointed in respect of an area consisting of the whole of England.
(3) The company is appointed as the highway authority for all highways within that area for which the Secretary of State for Transport was the highway authority immediately before this Order came into force, except for-
(a)the M6 Toll Road;
(b)the eastbound carriageway of the M48 motorway from the boundary with Wales to a point 400 metres east of the outer edge of the eastern abutment of the Aust Viaduct;
(c)the westbound carriageway of the M48 motorway from a point 500 metres east of the outer edge of the eastern abutment of the Aust Viaduct to the boundary with Wales;
(d)the eastbound carriageway of the M4 motorway from the boundary with Wales to a point 60 metres east of the Binn Wall and 140 metres north of the Severn Tunnel Air Shaft;
(e)the westbound carriageway of the M4 motorway from a point 60 metres east of the Binn Wall and 140 metres north of the Severn Tunnel Air Shaft to the boundary with Wales.

This Order appoints Highways England Company Limited (Company No. 9346363), ("Highways England"), as a highway authority for all highways in England for which the Secretary of State for Transport was the highway authority immediately before this Order was made, except for the M6 Toll Road and the roads that form part of the Severn Crossings up to the border with Wales. Those highways not transferred to Highways England are currently operated under concession agreements and the Secretary of State for Transport remains the highway authority in respect of them. Under section 1(4) of the Infrastructure Act 2015, by virtue of this Order, Highways England is a strategic highways company.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
