The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 25(1) and 272(7) and (8)(a) of the National Health Service Act 2006(1).
In accordance with section 25(3) of that Act, the consultation prescribed in regulations made under that section has been completed(2).
1.-(1) This Order may be cited as the East Lancashire Hospitals National Health Service Trust (Establishment) and the Blackburn, Hyndburn and Ribble Valley Health Care National Health Service Trust and Burnley Health Care National Health Service Trust (Dissolution) (Amendment) Order 2017 and comes into force on 10th February 2017.
(2) In this Order, "the Establishment Order" means the East Lancashire Hospitals National Health Service Trust (Establishment) and the Blackburn, Hyndburn and Ribble Valley Health Care National Health Service Trust and Burnley Health Care National Health Service Trust (Dissolution) Order 2002(3).
2. For article 4 of the Establishment Order (directors of the trust) substitute-
4.-(1) The trust must have, in addition to the chairman, 7 non-executive directors and 5 executive directors.
(2) Since the trust is to be regarded as having a significant teaching commitment, one of the non-executive directors must be appointed from the University of Central Lancashire.".

This Order amends the East Lancashire Hospitals National Health Service Trust (Establishment) and the Blackburn, Hyndburn and Ribble Valley Health Care National Health Service Trust and Burnley Health Care National Health Service Trust (Dissolution) Order 2002, which established the East Lancashire Hospitals National Health Service Trust.
Article 2 increases the number of non-executive directors, in addition to the chairman, the trust must have from 6 to 7, one of whom must be appointed from the University of Central Lancashire.
A full impact assessment has not been produced for this instrument as it has no effect on private sector or civil society organisations, and no significant effect on the public sector.
2006 c.41. Section 179(2) of the Health and Social Care Act 2012 (c.7) provides for the repeal of section 25 of the 2006 Act but this provision is not yet in force.
S.I. 2010/743, to which there are amendments not relevant to this Order. The prescribed consultation under regulation 2(2) of S.I. 2010/743 is, before making an order under section 25(1) of the 2006 Act in relation to an NHS trust, consultation by the Secretary of State with that NHS trust.
S.I. 2002/2073; relevant amending instrument is S.I. 2011/2223, relevant amendments include increasing the number of non-executive directors from 5 to 6.
