The Secretary of State makes the following Regulations in exercise of the powers conferred by paragraph 4(2) and (3) of Schedule 2 to the Welfare Reform and Work Act 2016(1).
1. These Regulations may be cited as the Social Housing Rents (Exceptions and Miscellaneous Provisions) (Amendment) Regulations 2019 and come into force on 23rd April 2019.
2.-(1) The Social Housing Rents (Exceptions and Miscellaneous Provisions) Regulations 2016(2) are amended as follows.
(2) In regulation 19(3) after paragraph (2) insert-
"(2A) Subject to paragraph (5), the accommodation is provided by a private registered provider(4) under an agreement with the Cambridgeshire and Peterborough Combined Authority(5) -
(a)to provide the accommodation pursuant to paragraph 20 of the Cambridgeshire and Peterborough Devolution Deal of 16th March 2017(6), and
(b)which permits the accommodation to be let as social housing at an affordable rent.
(2B) Subject to paragraph (5), the accommodation is provided by a private registered provider under an agreement with one or more of the local authorities specified in paragraph (2C) -
(a)to provide the accommodation pursuant to the Oxfordshire Housing and Growth Outline Agreement of 22nd November 2017(7), and
(b)which permits the accommodation to be let as social housing at an affordable rent.
(2C) For the purposes of paragraph (2B), the specified local authorities are-
(a)Cherwell District Council,
(b)Oxford City Council,
(c)South Oxfordshire District Council,
(d)Vale of White Horse District Council,
(e)West Oxfordshire District Council.".

These Regulations amend the Social Housing Rents (Exceptions and Miscellaneous Provisions) Regulations 2016 which, amongst other things, define affordable rent housing for the purposes of the Welfare Reform and Work Act 2016 (c. 7).
Regulation 2 of these Regulations amends that definition by identifying another category of accommodation that may be let at an affordable rent, that is accommodation provided by a private registered provider of social housing pursuant to the relevant paragraph of either an agreement between Government and local leaders in Cambridgeshire and Peterborough of 16th March 2017, or an agreement between Government and the local authorities in Oxfordshire of 22nd November 2017, under which funding is allocated to support the delivery of social housing let at an affordable rent in these areas.

A full impact assessment has not been produced for this instrument as no significant impact on the private, voluntary or public sector is foreseen.
There has been an amendment to regulation 19 which is not relevant to this instrument.
