The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980( 1) and now vested in him( 2):-
In accordance with section 10(2) of that Act, the Secretary of State has taken into consideration the requirements of local and national planning, including the requirements of agriculture, and is satisfied as to the expediency.
This Order is made in compliance with the provisions of Parts I and III of Schedule 1 of that Act.
1. This Order may be cited as the A5 and B4579 Trunk Roads (Mile End Roundabout Upgrade (Oswestry)) (Detrunking) Order 2021 and shall come into force on 4th November 2021.
2. In this Order –
(1) all measurements of distance are measured along the route of the relevant highway.
(2) –
(a) “National Highways” means National Highways Company Limited (Company No. 9346363), a strategic highways company, which is a company registered in England and Wales and whose Registered Office is Bridge House, 1 Walnut Tree Close, Guildford, Surrey GU1 4LZ;
(b) “the plan” means the plan numbered ‘70046089-SK-004’ marked “The A5 and B4579 Trunk Roads (Mile End Roundabout Upgrade (Oswestry)) (Detrunking) Order 2021” signed by authority of the Secretary of State for Transport and deposited at Deposited Document Services, One Priory Square, Priory Street, Hastings, East Sussex, TN34 1EA;
(c) “classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(d) “the new trunk roads” means the new trunk roads defined in “The A5 Trunk Road (Mile End Roundabout Upgrade (Oswestry)) (Trunking) Order 2021”, and
(e) “the trunk roads” means the A5 North Trunk Road and the B4579 Trunk Road.
3. The lengths of road described in the Schedule to this order shall cease to be trunk roads and shall be classified as classified roads from the date on which National Highways notifies Shropshire Council that the new trunk roads are open for traffic.

Regulation 3
1. A length of the B4579 from its junction with the Mile End Roundabout, given reference letter F on the plan, eastwards for a distance 234 metres, given the reference letter E on the plan; and
2. A length of the A5 from its junction with the Mile End Roundabout, given reference letter I on the plan, northwards for a distance of 377 metres, given the reference letter J on the plan;
and shown by woven hatching on the plan.
(This note is not part of the Order)
The Order removes the trunk road status from lengths of the A5 North and B4579 near Mile End Roundabout in the County of Shropshire and makes them classified roads. The transfer in classification and responsibility for the classified roads takes place on the date on which National Highways notifies Shropshire Council that the new trunk roads are open to traffic.
1980 c.66. Section 10 is amended by the New Roads and Street Works Act 1991 (c.22), section 22(2)(a), and the Infrastructure Act 2015 (c.7), paragraph 10(2) of Schedule 1. There are further amendments to section 10 which are not relevant to this Order.
