The Minister for the Cabinet Office makes these Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018( 1) (“ the 2018 Act”) and section 41(1) of the European Union (Withdrawal Agreement) Act 2020( 2).
The requirements of paragraph 3(2) of Schedule 7 to the 2018 Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.
1. These Regulations may be cited as the UK Statistics (Amendment etc.) (EU Exit) Regulations 2021 and come into force on the 22nd day after the day on which they are laid.
2. In paragraph 1(3) of Schedule 1 to the Data Protection Act 2018( 3), in the definition of “social protection”, for “exit day” substitute “IP completion day”.
3. In Schedule 2 to the Public Contracts Regulations 2015( 4) (activities constituting works), for “exit day” substitute “IP completion day”.
4. In regulation 2(1) of the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 2015( 5) (interpretation), in the definition of “NACE Rev 2”, for “exit day” substitute “IP completion day”.
5. In Schedule 1 to the Concession Contracts Regulations 2016( 6) (activities constituting works), for “exit day” substitute “IP completion day”.
6. In Schedule 1 to the Utilities Contracts Regulations 2016( 7) (activities constituting works), for “exit day” substitute “IP completion day”.
7.—(1) The legislation set out in Schedule 1, so far as it forms part of domestic law by virtue of section 3(1) of the European Union (Withdrawal) Act 2018( 8), is revoked.
(2) The points in Annex XXI to the EEA agreement, as it forms part of domestic law, set out in Schedule 2 are omitted.
(3) Notwithstanding the revocation of Council Regulation (EC) No 2223/96, the reference to paragraph 2.48 of Annex A to that Regulation in section 17(3B)(a) (power to obtain information) of the Bank of England Act 1998( 9) is to be read as reference to that paragraph as it had effect immediately before the Regulation was revoked.

These Regulations are made in exercise of the powers conferred by section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 (c. 16)(“ the 2018 Act”) to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the UK from the European Union. In particular, these Regulations address deficiencies under paragraphs (a), (b), (c), (d) and (g) of section 8(2) of the 2018 Act.
These Regulations also make consequential provision in exercise of the power conferred by section 41(1) of the European Union (Withdrawal Agreement) Act 2020 (c. 1)in order to update references to “exit day” to “IP completion day” as a result of the creation of the implementation period by that Act.
These Regulations make amendments to legislation in the field of statistics and are made subsequent to the UK Statistics (Amendment etc.) (EU Exit) Regulations 2019 ( S.I. 2019/489). Part 2 amends primary legislation and Part 3 amends subordinate legislation. Part 4 revokes the EU regulations and EU decisions set out in Schedule 1. Part 4 also includes a saving provision, and amends Annex XXI to the EEA agreement as set out in Schedule 2.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
